Houndridge Holiday Cottages Terms and Conditions Conditions of hire 1. The hirer warrants that the subjects let are to be used for the purposes of a holiday and so accept that the letting is a holiday let to which
Section 12 (2) and paragraph 8 of Schedule 4 of the Housing (Scotland) Act 1988
apply, namely "a tenancy the purpose of which is to confer on the tenant the
right to occupy the house for a holiday." 2. The hirer shall not sub-let the premises or any part thereof. 3. The number of persons occupying the premises shall not exceed the number stated for the premises. 4. The Hirer binds and obliges himself to vacate the premises without demand at the termination of the period of hire and pay any outstanding bills. Departure time is 10am on the day of departure to allow us time to prepare the cottage. (Arrival time 16.00) 5. The Hirer binds and obliges himself to pay to the lessor in respect of any loss or damage beyond fair wear and tear. 6. Cancellation: The Hirer agrees that, in the event of Cancellation, while every effort will be made by the lessor to re-let, if a substitute cannot be found, the Hirer will be responsible for the period of tenancy booked. All cancellations must be in writing and signed by the person who booked the holiday. 7. The Lessor may treat the booking as cancelled if the balance of the payment is not sent by the date agreed in the booking agreement, and every effort will be made to re-let the vacancy. If we are successful in re-letting we will return any monies paid less the deposit. 8. The Hirer shall, at all times keep the hired premises in a clean and tidy condition and ensure that it is left as found on arrival. We reserve the right to charge for any heavy cleaning required. 9. The Hirer shall undertake to prevent any member of his party from causing a nuisance or disturbance to other residents or occupiers. 10. The Hirer undertakes to leave the hired premises secure if left unoccupied during the period of let. 11. The Hirer undertakes to relieve the lessor from any liability for damage of injury however caused by any memberof his party. 12. The Lessor, his agents or employees, accept no responsibility for loss, injury or damage to any member of the Hirer's party of their property, howsoever caused, arising in any manner out of the let of the premises. 13. No pets are permitted in any of the cottages or houses. 14. Force Majeure -We cannot accept any responsibility or pay any compensation where we are unable to fulfil the contract or it is affected by reason of circumstances beyond our control which amount to force majeure - Such circumstances include criminal damage, explosion, adverse weather, riot, fire, flood and all situations beyond our control. 15. We reserve the right to pass on any bank charges and other costs incurred if payments are in another currency or if payment is by a method not used by us or if a cheque has to be re-presented. 16. No smoking permitted in any of the cottages, houses or leisure facilities.
